“The Social Security Fairness Act recently passed eliminating the Windfall Elimination Provision and Government Pension Offset for those who receive a pension based on work that wasn’t covered by Social Security. Some persons may not have filed for Social Security spousal or widows or widowers benefits in the past because Government Pension Offset may have totally offset the benefit. Those persons should file for those benefits without delay because a new application for benefits may not be retroactive. However, widows and widowers have some options that don’t apply to persons whose spouse is living. Widows and widowers affected by Government Pension Offset would not have been concerned with those options before but they now should explore those options in order to maximize their benefits. Particularly, those widows or widowers who are younger than full retirement age and have not yet filed for benefits may want to explore those options before deciding whether to file for their own retirement benefits or the widows benefits first. It can be complicated but making the right decisions can make a big difference in total lifetime benefits received.“
